Vacation Rentals of Tamarindo: Terms And ConditionsShort Term Rental Agreement FIRST: Electricity, water, phone local calls, Cable TV
INCLUDED IN THE RATE. SECOND:
Cleaning twice a week included if the stay is for a week or more. THIRD: NO PETS ALLOWED. FOUR: NO SMOKING INSIDE THE CONDOS.
$400 USD penalty applies in the case we found smoke smell in the property. FIVE: Please keep noise and music to a
reasonable level at all times. Quiet policy after 10pm. No noise around the
pool after 7:00PM. Please be respectful of your surrounding neighbors.
Excessive loud noise levels will result in expulsion of the property with NO
REFUNDS. SIX: Management is NOT
responsible for loss or theft of valuables.
Please use the safe provided in each condo. SEVEN: From time to time, the Electricity, Internet, Cabel TV, Water
or other service not provided directly by the Property Manager may be turned
off temporarily by the Costa Rican authorities. Please note that the Property Management
Company has no control over these situations and accepts no liability for loss
of food due to power failures. No
refunds will be given as a result of power and water failures. EIGTH: Tenant accepts OBEY ALL POOL
RULES. No surfboards in the pool or
glass in the pool area please. NINE: Term:
This rental agreement is from the dates picked in the online reservation
form. TEN: Payments: VRT accepts
Credit Cards, Costa Rican Checks, Wire Transfers and Cash for payment. When paying by credit card, a 5% service fee
applies. When paying by international
bank wire transfer, a $25.00 USD bank service fee applies. Within Costa Rica, the LESSEE can transfer
money using Banco National or BCR fee of charge, or use the SINPE system from
any other Costa Rican bank. In addition, the LESSEE will need to authorize
payment of 50% of the total anticipated rental charges. Once the signed agreement is received and the
payment is registered on our account, the LESSEE will receive confirmation via
fax or email. The remaining balance is
due 60 days prior to the check-in date.
We reserve the right to treat the booking as cancelled if the balance is
not paid on time and penalties will apply. ELEVEN:
Holidays weeks reservations should be prepaid at the booking time with a
deposit of 100% of the total of the stay. Deposits received for holiday weeks
(Christmas, New Years and Easter) are non-refundable. TWELVE:
Cancellation of a confirmed rental agreement prior to 60 days to the arrival
date will result in a 50% penalty of the deposit. 45 days prior to the arrival date will result
in a 75% penalty of the deposit. 30 days
prior to arrival date will result in a 100% penalty and all deposits will be
forfeited in total. No exceptions will
be made. THIRTEEN: The price of the
lease is the sum in the online rental form in US dollars. Credit card or wire fee is not included. FOURTEEN: A $500-$1000 security deposit
is due upon arrival. VRT accepts Credit
Cards or Cash for the security deposit.
A temporary HOLD will secure the deposit. The LESSEE must report any
damage to their unit or any missing items immediately or it will be deemed that
they are responsible for said damage. If
the unit is found in appropriate order following your departure, the full value
of the security deposit will be refunded to the LESSEE upon check-out. In all other cases, the cost of any damages
or missing items will be deducted from the security deposit before refunding
the remaining balance. FIFTEEN: It
is specifically understood by the parties that this lease is made in connection
with a Condominium Unit. This lease is subject and subordinate to all covenants
and restrictions contained in the Condominium Bylaws. SIXTEEN: No refunds will be made due to unfavorable weather, disruption
of utility services by the provider, excessive noise levels or early departures
due to illness or death. SEVENTEEN: The
maximum occupancy is noted on the rental form. The responsible adult signing
the rental agreement and posting security deposit must be at least 25 years of
age. No Exceptions. EIGHTEEN: Each
tenant will be provided with 2 sets of keys upon check-in. The keys must be
returned to the property management office upon check-out. Arrangements to return the keys must be made
if departing before normal business hours. In case the tenant leave in no
business hours it should drop the keys in the Metal box located in Sunrise
Tamarindo Complex guard house. Tenant cannot leave the keys with the guard.
Should a set of keys be lost by the LESSEE, a charge of $100.00 will be deducted
from the security deposit. NINETEEN:
The unit is delivered furnished and equipped. The property will be inspected by
the inventory manager prior to your
arrival and immediately before your departure.
In addition, you will be need to review and sign the inventory list of
the unit's contents upon arrival and upon departure. Please allow 1 hour prior to check-out to
conduct the final inventory of the unit.
For late arrivals, please review and sign the inventory list and return
the inventory list to the management company the following morning. For early
morning check-outs, the inventory manager will conduct an inspection of the
property immediately following your departure.
If the unit is found in appropriate order following your departure, the
full value of the security deposit will be released from the temporary hold of
the security deposit. TWENTY: Late
check outs will be a penalty of $50 per hour. TWENTY ONE: The space will be used as temporary domicile of the
LESSEE, only, not being able to vary this use totally nor partially for any
reason, whatsoever. TWENTY TWO: The
LESSEE cannot, in any way whatsoever, sublease, assign, encumber, lien, or tax,
totally or partially, the rights conferred herein. He also promises to faithfully respect the
condition of not having ANY TYPE OF PETS inside or outside the building. TWENTY THREE: Release of
Liability: The LESSOR does not assume
any liability whatsoever before third parties, for damages to objects of his
possession or to persons who are in the property leases, for accidents of any
nature, fire, or any other catastrophe that could occur both to persons and to
goods, whether caused by man or nature, or by an Act of God of by force majeure
or robbery. In virtue of this clause,
the LESSOR is hereby relieved of any responsibility to this effect. TWENTY FOUR: Sanctions: Non-compliance on the part of the LESSEE of
any of the obligations he assumes herein, or of those imposed by law, will give
the LESSOR the right to file whatever legal actions are pertinent, and if the
case may be, of terminating the agreement with liability for the LESSEE,
without the delay or omission in the exercise of those rights, implying a
waiver or expiration of them. TWENTY
FIVE: At check out time if the property has some damage will be deducted
from the security deposit. TWENTY SIX:
The property will be cleaned after the LESSEE leave the unit, if extra cleaning
is needed because the property is very dirty an extra charge of $15 USD will be
charges by hour from the security deposit or credit card on file. I hereby acknowledge that I have read, and accept the
"Terms and Conditions of VRT" listed above. The parties herein have agreed in entering
into, as in effect into, a Lease Agreement of House for Tourist Purposes that
will be ruled by the following contractual clauses and whatever is omitted
therein, by the provisions of the General Urban and Suburban Law of Costa Rica
in force hereinafter referred as "The Law". |
